Trusty, Attorney at Law, Batesville, Mississippi Representing Employer: Gray Eddmondson, Attorney at Law, Oxford, Mississippi FULL COMMISSION ORDER The Commission heard the above styled cause on February 28, 2005 in the offices of the Mississippi Workers' Compensation Commission, Jackson, Mississippi, on employer and carrier's 'Petition for Full Review.ø Having heard the arguments offered on behalf of the parties and having thoroughly studied the record and the applicable law, the Commission amends the order of the Administrative Judge dated August 2, 2004. In amending the order, the Commission has determined that the Administrative Judge erred in finding that the claimant sustained an industrial loss of use of his right upper extremity. We find that the industrial loss suffered by the claimant was to his right second (middle) finger. In making this distinction between the industrial loss of use of the second (middle) finger of the right hand, rather than the right upper extremity, we have considered the following facts: The claimant sustained an injury to his right second (middle) finger which resulted in an amputation of the tip of the finger. * Dr. Alan Pritchard, hand surgeon, amputated the end of claimant's middle finger on the date of injury, and after following him for approximately three weeks, released the claimant to return to normal work duties, which were manufacturing in nature. * Dr. Pritchard determined that the claimant had sustained a...
