INTRODUCTION
This
matter came before Magistrate John M. Sims for trial in the
Escanaba division of the Board of Magistrates on August 6,
2019. Attorney Gabriel Cameron appeared on behalf of the
Plaintiff and Attorney Laura Dinon appeared on behalf of the
Defendants G & G Lumber and Travelers Insurance.
This
case was tried in a very summary fashion. No witnesses were
called by either party and no standard stipulations were
entered into at the time of trial. The Plaintiff offered as
exhibits medical billings and summaries. Defendant offered
medical billings and statement of payments as well. Both
parties indicated that none of the medical bills had been
timely paid but that all but two bills were accounted as paid
at the time of trial, most being paid in the last 6 to 8
weeks before trial.
To
understand this matter it is best to understand the history
of the case and the Application for Hearing - Form C filed by
the Plaintiff to initiate this particular stage of the
multiple year litigation this case has followed (see,
attached Application for Hearing - Form C).

case started as a normal workers' compensation case
alleging an injury date of September 20, 2009.
