WORKERS' COMPENSATION APPELLATE COMMISSION DECISION OF THE APPELLATE COMMISSION GILROY.The petitioner-employee appeals from a decree of Trial Commissioner Arrigan which denied her petition to review seeking an order compelling payment of certain medical treatment bills. We affirm the trial commissioner. This matter was heard by the trial commissioner on the employee's petition alleging nonpayment of various medical expenses. Introduced into evidence was a decree between the parties in W.C.C. No. 79-1238 which found that this employee sustained an injury to her right knee on December 12, 1978 while in the employ of International Telephone and Telegraph Corporation (Royal Electric). Said decree was entered on December 3, 1979 and ordered the payment of incapacity benefits and the payment of medical and hospital expenses as a result of that right knee injury. The petitioner testified that she had an operative procedure performed by Dr. Geret DuBois in 1984 on her right knee, and that she has experienced continued discomfort and pain in her right knee which required wearing a knee brace. The petitioner returned to Dr. DuBois and had surgery again in June of 1988. Throughout this period she said she took medication as needed, and that she wears a knee brace from time to time as needed. An affidavit pursuant to Section 9-19-27 and a bill for services from Dr. Geret DuBois running from February 11, 1988 to February 14, 1989, including a surgical procedure, was made part of this record, which bill amounts to fifteen hundred and ten ($1,510.00). That affidavit also contains an operative report for June 15, 1988 which sets forth that an arthroscopy and shaving of a portion of synovium was done under general anesthesia at Pawtucket Memorial Hospital. Dr. Geret DuBois testified that in May of 1988 he performed an arthroscopy of Mrs. Funchion's knee which he described as an investigative procedure of the knee using a surgical telescope placed within the knee joint.
