Udy asks The Industrial Commission of Utah to review the Administrative Law Judge's decision denying Mr. Udy's request for an evidentiary hearing on his claims of employment discrimination against U.S. West Communications, Inc. The Commission exercises jurisdiction in this matter pursuant to Utah Code Ann. §63-46b-12, Utah Code Ann. §34-35-7.1(11) and Utah Admin. Code R560-1-4.A.5. BACKGROUND Mr. Udy filed various claims of unlawful employment discrimination against U.S. West with the Utah Antidiscrimination Division. After investigating Mr. Udy's claims, the Division's Director issued a "no cause" determination in U.S. West's favor. Mr. Udy filed a request for an evidentiary hearing, which request was denied by the ALJ. Mr. Udy then filed a Motion For Review asking the Commission to reverse the ALJ's decision and to grant an evidentiary hearing in this matter. DISCUSSION AND CONCLUSIONS OF LAW The...
