The Commission exercises jurisdiction over this Motion For Review pursuant to Utah Code Ann. '63-46b-12, Utah Code Ann. '35-1-82.53 and Utah Admin. Code R568-1-4.M. FINDINGS OF FACT The Commission adopts the findings of fact set forth in the ALJ's decision. In summary, Mr. Kay was injured on December 14, 1990 in the course of his employment for Wells Fargo. He received medical treatment at the University Hospital for injuries to his left shoulder, hip, left knee and right ankle. After his accident, Mr. Kay continued to suffer pain in his left shoulder. He received medical treatment for the left shoulder, including surgery and physical therapy, for the next several months. Then, during October 1991, Mr. Kay began to complain of pain in his right shoulder. At this point, the focus of Mr. Kay's medical treatment shifted to his right shoulder. He received medical attention, physical therapy and ultimately surgery on the right shoulder. During May 1993, at Wells Fargo's request, Dr. Ruoff examined Mr. Kay. Dr. Ruoff concluded that neither Mr. Kay's problems with his right or left shoulder were related to his industrial injury. Wells Fargo paid all Mr. Kay's medical expenses as well as temporary total disability compensation from December 14, 1990, the date of the accident, until May 20, 1993.
