Laird asks The Industrial Commission of Utah to review the Administrative Law Judge's Order, which dismissed without prejudice Mr. Laird's claim for benefits under the Utah Workers' Compensation Act. The Industrial Commission of Utah exercises jurisdiction over this Motion For Review pursuant to Utah Code Ann. §63-46b-12, Utah Code Ann. §35-1-82.53, and Utah Admin. Code R568-1-4.M. BACKGROUND On October 25, 1994, Mr. Laird initiated this proceeding by filing an Application for workers' compensation benefits. Then, on November 4, 19 94, Mr. Laird's attorney advised the Adjudication Division that the parties were pursuing settlement and that Mr. Laird had excused the defendants from answering his Application until further notice. Mr. Laird's attorney further advised that the Application should "be put on hold" pending the parties' settlement negotiations. On November 8, 1994, the ALJ dismissed Mr. Laird's claim without prejudice on the grounds that "no justiciable dispute existed" at that time.
