Relating to insurance; to provide further for the3
regulation of Medicare supplement insurance and long-term care4
insurance by amending Sections 27-19-52, 27-19-53, 27-19-54,5
27-19-55, 27-19-56, and 27-19-57, and by adding Sections6
27-19-52.1, 27-19-57.1, 27-19-57.2, and 27-19-59, Code of7
Alabama 1975, and adding an Article 3 (commencing with Section8
27-19-100) to Chapter 19 of Title 27 of the Code of Alabama9
1975, establishing the "Long-Term Care Insurance Policy10
Minimum Standards Act" and authorize the promulgation of11
regulations therefor by the Commissioner of Insurance, and by12
amending Section 10-4-115, Code of Alabama 1975.13
BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:14
Section 1. Sections 27-19-52, 27-19-53, 27-19-54,15
27-19-55, 27-19-56, and 27-19-57, Code of Alabama 1975, are16
amended to read as follows:17
"§27-19-52.18
"For purposes of this article, the following terms19
shall have the meaning indicated herein:20
"(1) APPLICANT. Includes either of the following:
21
"a. In the case of an individual Medicare supplement22
policy or subscriber contract, the person who seeks to23
contract for insurance benefits, and .24

"b. In the case of a group Medicare supplement1
policy or subscriber contract, the proposed certificate holder.2
"(2) CERTIFICATE. Any certificate issued under a3
group Medicare supplement policy, which policy has been4
delivered or issued for delivery in this state.5
"(3) CERTIFICATE FORM. The form on which the6
certificate is delivered or issued for delivery by the issuer.

"(4) ISSUER. Insurance companies, fraternal benefit8
societies, health care service plans, health maintenance
9
organizations, and any other entity delivering or issuing for
10
delivery in this state Medicare supplement policies or
11
certificates.

"(5) MEDICARE. The "Health Insurance for the Aged13
Act," Title XVIII of the Social Security Amendments of 1965,
14
as then constituted or later amended.

"(3)(6) MEDICARE SUPPLEMENT POLICY. A group or16
individual policy of disability insurance or a nonprofit17
hospital and medical plan contract or a subscriber contract of
18
a health maintenance organization, other than a policy issued
19
pursuant to a contract under Section 1876 of the federal
20
Social Security Act (42 U.S.C. Section 1395, et seq.), or an
21
issued policy under a demonstration project specified in 42
22
U.S.C. Section 1395ss (g)(1), which is advertised, marketed or23
designed primarily as a supplement to reimbursements under24
Medicare for the hospital, medical or surgical expenses of25
persons eligible for Medicare. Such term does not include:
