I.
BACKGROUND
This
matter comes before the Commission on a motion to dismiss by
Respondents. A hearing on the motion was conducted on April
18, 2019 in Little Rock, Arkansas. No testimony was taken in
the case. Claimant, who according to Commission records is
pro se, failed to appear at the hearing. At
Respondents’ request, the Commission file on this claim
has been incorporated herein in its entirety by reference.
The
record reflects the following procedural history:
Per the
Form AR-1 filed on September 27, 2018, Claimant purportedly
injured his lower back at work on July 19, 2018 while lifting
packages. According to the Form AR-2 also filed on September
27, 2018, Respondents controverted the matter in its
entirety, contending that there was no medical evidence of
such an injury. On September 28, 2018, Claimant filed a Form
AR-C. Therein, he requested reimbursement of medical
expenses, rehabilitation, temporary partial disability
benefits, and compensation for missing 24 days of work
(essentially, temporary total disability benefits).
Claimant
requested a hearing via email to the Clerk of the Commission
on October 22, 2018. The file was assigned to my office on
November 16, 2018. On November 19, 2018, I sent prehearing
questionnaires to the parties by mail. Respondents’
counsel made an entry of appearance on November 21, 2018.
When no questionnaire response by Claimant was forthcoming, I
wrote him on December 12, 2018. In that letter, I informed
