Williams Senior Assistant Attorney General QUESTION No. 1: Are pin pockets "approved safety devices" when used with pins to prevent shifting or movement of cargo on a vehicle during transportation or are they "load holding devicestt that must be included in the width of the vehicle?ANSWER: If used during transporation, they are load holding devices and not approved safety devices. (See discussion) QUESTION No. 2: If pin pockets are allowed as "safety devices", would the use of these vehicles be legal when transporting loads and not using pins in the pin pockets and/or when being transported empty? ANSWER: Premise is wrong. (See discussion) DISCUSSION Applicable statutes read as follows: W.S. 31-5-1001(a)(xxxiii). 'Width'.-- The total outside transverse dimension of a vehicle including any load or load-holding devices thereon, but excluding approved safety devices and tire buldge due to load; W.S. 31-5-1002 states in part: (1) Width--interstate or national defense highways: (A) No vehicle except busses and motor vehicles hauling forest products or baled hay, unladen or with load or load-holding device thereon shall exceed ninety-six (96) inches in width (eight (8) feet). (ii) Width--primary and secondary: (A) No vehicle operating on paved highways twenty (20) feet or over in width shall exceed one hundred two (102) inches (eight and one-half (8-1/2) feet) in width. (B) No vehicle operating on paved highways less than twenty (20) feet in width shall exceed ninety-six (96) inches (eight (8) feet) in width. Pin Pockets are a device on the outside ends of tailrolls in which stock pins may be placed to guide and control equipment being loaded by using the winch on a semi trailer. They are also used incidental to and supplemental to other devices to prevent shifting of the load during transportation.
