Your letter states:

It is our understanding that as of June 29, 2006 as per above mentioned which was signed by the Governor and approved by the Justice Department for a pay increase of $84.00 per diem. We request an opinion of whether or not the Washington County Board of Supervisors has to approve our pay increase.

         Mississippi Code Annotated Section 23-15-153 (2) (Revised 2001) as amended by Chapter 592., 2006 General Laws of Mississippi provides in part:

Except as provided in subsection (3) of this section, and subject to the following annual limitations, the commissioners of election shall be entitled to received a per diem in the amount of Eight-four Dollars ($84.00), to be paid from the county general fund, for every day or period of no less than five (5) hours accumulated over two (2) or more days actually employed in the performance of their duties in the conduct of an election or actually employed in the performance of their duties for the necessary time spent in the revision of the registration books and
