It is unlawful for any person to discharge sewage or drainage, except surface drainage, on, or within the legal limits of, any State highway.

Any sewer outlet placed or located within the limits of a State highway, or so located that the discharge therefrom enters a State highway, is hereby declared to be a violation of this section, and a public nuisance, and may be blocked or removed by the department.

Any person violating any of the provisions of this section shall, upon summary conviction thereof, be sentenced to pay a fine of not less than five dollars ($5.00) nor more than twenty-five dollars ($25.00), or, in default of payment of said fine and costs, to be imprisoned in the county jail for a period of one day for each dollar of fine and costs unpaid.
