FINAL EVIDENTIARY ORDER GRANTING, IN PART, EMPLOYER/CARRIER’S

VERIFIED MOTION TO TAX COSTS

THIS CAUSE came before the undersigned Judge of Compensation Claims (“JCC”) for

an evidentiary hearing in Tallahassee, Leon County, Florida, on August 17, 2026, on the

Employer/Carrier’s Verified Motion to Tax Costs Regarding Dismissal of Petition for Benefits

filed on October 9, 2025, filed May 18, 2026. The Employer/Carrier’s supplemental motion,

filed July 21, 2026, was also considered. Todd Hunter, Esquire, appeared at the hearing on

behalf of Kevin Sullivan (“Claimant”). Christopher DuBois, Esquire, appeared at the hearing on

behalf of the Department of Corrections (“Employer”) and the Division of Risk Management

(“Carrier”) and testified. Exhibits admitted into evidence are listed in the Appendix.

Findings of Fact and Conclusions of Law:

In making my findings of fact and conclusions of law, I have had the opportunity to

review and consider all the evidence presented before me and have attempted to resolve any

conflicts in the evidence. After hearing argument of counsel, and having considered the

applicable law, I find as follows:
