         Mr. Henry Dean Horton          Winston County Circuit Clerk          Post Office Box 371          Louisville, Mississippi 39339          Fees of Circuit Clerk (State Fail Cases)           Dear Mr. Horton:          Attorney General A. F. Summer is in receipt of your letter of January 27, 1977 and it has been reassigned to me for research and reply. Please accept our apologies for the delay in reply thereto.
Your letter stated: “I would greatly appreciate your written opinion on the following. Since Winston County has an evaluation of a Class One County and an amount greater than is set forth in Mississippi Code 25-7-13, section four (4), subsection (c), would I be entitled to receive fees for State Fail Cases under that section? Also, receive fees for self and Deputies under section (3), subsection (e) of 25-7-13?”
         With regard to your first question as to receiving fees for State Fail Cases, Class One Counties are defined by Section 25-3-1, Mississippi Code of 1972 as follows:
“...shall be composed of all counties in which the assessed valuation equals and exceeds twenty-five million dollars.”
