APPEARING FOR CLAIMANT: Al Chadick, Esquire
APPEARING FOR EMPLOYER/CARRIER: Amy Taylor, Esquire
ORDER FOR INDEPENDENT MEDICAL EXAMINATION
DENEISE TURNER LOTT, ADMINISTRATIVE JUDGE
matter comes before the Commission on a telephonic hearing
with all counsel on December 5,2018, on Claimant's
Motion to Compel Medical Treatment filed on November
14,2018 and on Employer and Carrier's Response to
Claimant's Motion to Compel Medical Treatment filed
on December 3, 2018.
following facts were gleaned from those documents in the
Commission file which comprise the record pursuant to
Mississippi Workers' Compensation Commission Rule 2.10,
including the pleadings and attachments:
September 12,2017, Claimant had an arthroscopic procedure on
her left knee by Dr. James Green, Jr., Meridian Orthopaedic
Clinic, for a non work-connected impairment. She
returned to work on October 16, 2017.
November 11,2017, Claimant re-injured her left knee when she
stepped in a hole or "dip" in the floor at work,
and her left knee popped.
Green initially thought Claimant did not have a new injury on
November 11, 2017, but after further treatment and
evaluation, including a review of the MRI taken May 2, 2018
which showed rapid progression of the degeneration of her left
knee, Dr. Green related Claimant's current impairment and
need for treatment to both her pre-existing condition and to
her November 11, 2017 work injury.
May 3, 2018, Dr. Green recommended Claimant undergo
viscoelastic supplemental injections. On June 27,2018 and
August 6,2018, Dr. Green continued to recommend viscoelastic
supplementation injections in an attempt to delay the need
for surgical intervention.
