KENNEDY, ADMINISTRATIVE LAW JUDGE.          STATEMENT OF THE CASE          A hearing was held in the above styled matter on October 7, 2019, in Conway Arkansas on Respondent’s Motion to Dismiss for failure to prosecute pursuant to Ark. Code Ann. §11-9-702 and Rule 099.13 of the Arkansas Workers’ Compensation Act. The first alleged incident in question occurred on or about December 1, 2017, with the Claimant filing a claim for initial and additional benefits on or about June 4, 2018, by filing a Form AR-C with the Arkansas Workers’ Compensation Commission, alleging a work-related back injury on December 1, 2017. The second alleged incident in question occurred on or about May 3, 2018, with the Claimant filing the claim for initial and additional benefits on or about July 3, 2018, by filing an AR-C Form, contending that he sustained a work-related back injury on May 3, 2018. The Respondent’s controverted both claims. On August 26, 2018, the Respondents forwarded Interrogatories to the Claimant’s then counsel, and the Claimant failed to respond within the appropriate time period. On March 29, 2019, the Claimant’s counsel filed a Motion to Withdraw as Counsel, which was granted by the Full Commission on April 25, 2019. As of this...
