Plaintiff has not sustained a work-related injury and/or
work-related disability and is entitled to no benefits
pursuant to the Workers’ Disability Compensation Act.

Background
This
matter originally came before the Agency on Plaintiff’s
Petition for Hearing, received May 2, 2005, alleging injury
to head, neck and body in a car accident. Defendant file
their own Petition For Hearing – Form C, received March
28, 2006, seeking a determination that Plaintiff had not
sustained a work-related injury or work disability. In an
Order mailed April 25, 2006, Defendant’s Motion to
Suspend and Forfeit Compensation for Plaintiff’s
failure to attend an independent medical examination was
granted. In an order mailed the same day, Plaintiff’s
Petition for Hearing was dismissed.
Plaintiff
filed another Application for Hearing, received June 8, 2006.
Defendant subsequently again filed a Form C, received July 7,
2006, again seeking a determination that Plaintiff did not
sustain a work-related injury or work disability. In an
order, mailed October 10, 2006, Plaintiff’s application
was withdrawn at the request of plaintiff/ plaintiff’s
