         Honorable J. L. Mathis          Clerk of the Circuit Court          Benton County          Ashland, Mississippi           Dear Mr. Mathis:          You submit the following question, to wit:
“Where a person has been convicted of the crime of embezzlement in the State of Tennessee and serves a term in the penitentiary of that State, is such person disqualified from voting or holding office in the State of Mississippi?”
         In the case of State ex rel Muirhead vs. State Board of Election Commissioners, 250 So. 2nd 698, the Mississippi Supreme Court cited the Mississippi case of State ex rel Mitchell vs. McDonald, 164 Miss. 405, as follows,. . . that in order to disqualify a person from serving in an elective office within Mississippi, the person must have been convicted by a court in...
