         Mr. Kent McDaniel          Director          Mississippi Law Enforcement Officers' Training Academy          Route 6, Box 132          Pearl, Mississippi 39206          Re: Open Records / Student Records           Dear Mr. McDaniel:          Attorney General Bill Allain has received your letter of July 26, 1983, and has assigned it to me for reply. In your letter you state:
“Pursuant to our conversation on the telephone, I am writing to ask the Attorney General's Office for an opinion relating to the new public records legislation. Specifically, I find no language in Senate Bill 2448, Chapter 424, Laws of Mississippi, 1983, which will allow me to hold as confidential the records of student performance here at the Academy. These are records relating to all areas of performance, including test grades, physical skills evaluations, disciplinary reports, and the like. My existing policy considers such records to be confidential, and they will be released only to the student, his sponsoring agency, or to a third party with the student's written authorization. I have attached a copy of that section of the policy for your information. That policy was written to conform to existing policy in most educational institutions, since I believe the type records maintained are very similar.
