The Court hereby recognizes that defendant Palmer Brothers Granite filed for bankruptcy on or about July 27, 2004. The Court also recognizes that an Order of Discharge was entered by the United States Bankuptcy Court (Nebraska) in favor of Palmer Brothers Granite on or about November 28, 2004. The plaintiff and defendant have represented to the Court that the plaintiff will proceed with her Workers’ Compensation Claim against Palmer Brothers Granite as a nominal defendant only.
