MONTANA ADMINISTRATIVE REGISTER
ISSUE NO. 7
The Montana Administrative Register (MAR or Register), a twice-monthly
publication, has three sections. The Proposal Notice Section contains state
agencies' proposed new, amended, or repealed rules; the rationale for the change;
date and address of public hearing; and where written comments may be submitted.
The Rule Adoption Section contains final rule notices which show any changes
made since the proposal stage. All rule actions are effective the day after print
publication of the adoption notice unless otherwise specified in the final notice. The
Interpretation Section contains the Attorney General's opinions and state declaratory
rulings. Special notices and tables are found at the end of each Register.

1. On June 26, 2015, the Public Employees' Retirement Board proposes to
amend the above-stated rule.
2. The Public Employees' Retirement Board will make reasonable
accommodations for persons with disabilities who wish to participate in this
rulemaking process or need an alternative accessible format of this notice. If you

3. The rule as proposed to be amended provides as follows, stricken matter
interlined, new matter underlined:
2.43.3505 ESTABLISHMENT OF LONG-TERM DISABILITY TRUST FUND
(1) remains the same.
(2) The long-term disability trust fund is a governmental plan under Internal
Revenue Code section 401(a)(24) and may be invested in one or more group trust
funds as determined by the Montana Board of Investments.
(a) The group trust fund or funds may be a group trust fund presently in
existence or later established as permitted under IRC section 401(a)(24), IRS
Revenue Ruling 81-100, IRS Revenue Ruling 2004-67, IRS Revenue Ruling 2011-1,
and IRS Revenue Ruling 2014-24.
(b) The group trust fund or funds must be operated and maintained
exclusively for the commingling and collective investment of monies pursuant to
applicable IRS guidance and must be adopted as a part of the long-term disability
trust fund.
(c) No part of the corpus or income of the long-term disability trust fund may
be used for, or diverted to, any purpose other than the exclusive benefit of the
disabled DCRP participants and their beneficiaries. This exclusive benefit provision
is irrevocable.
(2) and (3) remain the same but are renumbered (3) and (4).
