No privilege to witness in election trial

In trials of contested elections, and for offenses arising under the election law, no person shall be permitted to withhold his testimony on the ground that it may criminate himself, or subject him to public infamy; but such testimony shall not be used against him in any judicial proceeding, except for perjury in giving such testimony.

ANNOTATION

Where vote illegal, voter can be compelled to answer how he voted. If it is not shown that the vote was illegal, the voter cannot be compelled to answer how he voted; but if illegal, in addition to compelling him to answer, other evidence may be received and considered on the subject. People v. Turpin, 49 Colo. 234, 112 P. 539, 33 L.R.A. (n.s.) 766, 1912A Ann. Cas. 724 (1910).
