Gen. 22]Game commission cannot make and enforce a rule requiring a hunter to place both coupons from his license upon one Columbian black tail which he kills although the commission is authorized by law to reduce the bag limit on such deer.July 18, 1940.Oregon State Game Commission.Gentlemen: I am in receipt of your letter of July 15, 1940, in which you request my opinion whether or not your commission could make a rule requiring every hunter who kills one Columbian black tail deer to place both deer coupons on his hunting license on the one deer instead of only one coupon as provided in section 39-416, Oregon Code 1935 Supplement, paragraph (f), since your commission at its last meeting reduced the bag limit on Columbian black tail deer to one instead of two deer as provided in the statute. Said paragraph (f) reads, so far as pertinent to your question, as follows:
"All hunters' licenses shall have attached thereto two (2) deer coupons, and when such licensee shall take or kill any Columbian black tail deer, such person shall immediately detach from his license and attach to such deer in plain sight one (1) of such coupons. When such licensee shall legally take or kill any mule deer or white tail deer, such person shall immediately detach from his license and attach to such deer in plain sight both deer coupons. * * *"
