Dear Sir: Under date of July 31, 1940, you have requested that I advise you in view of chapter 302, Oregon Laws, 1939, whether or not the Bonneville Power Administration may build power lines over lands of the state of Oregon without charge, particularly state land board lands which are a part of the assets of the irreducible school fund under section 61-701, Oregon Code, 1930. Chapter 302, Oregon Laws, 1939, authorizes the state of Oregon, municipal and other public corporations owning or controlling any real property, to enter into agreements with the United States of America or any agency thereof, relative to the conditions for and places where electrical and other transmission lines may be placed and maintained across any such property. Section 832a, paragraph (b), U. S. C. A., 1935 Cumulative Annual Pocket Parts, authorizes the administrator of the Bonneville Project to provide, construct, operate, maintain and improve such electrical transmission lines and substations, and facilities and structures appurtenant thereto, as he finds necessary, desirable, or appropriate for the purpose of transmitting electric energy, available for sale, from the...
