Gen. 9]State of Oregon, acting by and through the state board for vocational education, may accept and administer federal funds appropriated by chapter 437, seventy-sixth congress, third session. Such funds should be deposited in and disbursed from the state treasury.July 5, 1940.Mr. O. D. Adams,State Director, State Board for Vocational Education. Dear Mr. Adams: I have your letter of July 5, 1940, submitting the question:
"Can the State of Oregon accept federal money under the act known as Public No. 668, Seventy-sixth Congress, Chapter 437, Third Session, Title I, passed by Congress during the present session and approved by the President on June 27, 1940, for vocational education of defense workers?"
10Said Act of Congress appropriates money
"For payment to States, subdivisions thereof, or other public authorities, through certification from time to time made by the United States Commissioner of Education to the Secretary of the Treasury of the name of such agency and the amount to be paid, * * * for the cost of courses of less than college grade, provided by such agencies in vocational schools pursuant to plans submitted by such agencies and approved by the United States Commissioner of Education, which plans shall include courses supplementary to employment in occupations essential to the national defense and preemployment refresher courses for workers preparing for such occupations selected from the public employment office registers; * * *".
Chapter III of Title XXXV, Oregon Code 1930, creates the state board for vocational education. Section 35-305, a part of said chapter, provides:
"The state board for vocational education shall have all necessary authority * * * to administer the funds provided by the federal government and the state of Oregon under the provisions of this
