Gen. 104]Agricultural Workers Health Association, organized for the purpose of securing medical care for indigent persons who are share croppers, farm laborers, or drouth refugees or other indigent persons not eligible for aid from the state, including medical, surgical, dental treatment or services, and any drugs, diets, nursing or hospitalization incident, necessary or convenient, without charge, is not subject to the provisions of Chapter IX, Title XLVI, Oregon Code 1930, relating to hospital associations.November 14, 1940.Mr. Seth B. Dear Mr. Thompson: You have submitted for my examination and consideration the articles of incorporation and by-laws of the Agricultural Workers Health Association, a letter of the regional attorney, United States department of agriculture, and data relating to the procedure for furnishing medical care to agricultural workers by said corporation, from which it appears that said corporation is to be organized for the purpose of securing for indigent persons who are share croppers, farm laborers, or drouth refugees or other indigent persons, who when last employed obtained a major portion of their livelihood from agricultural, horticultural, viticultural, forestry, dairy, livestock, poultry, bee or farm operations, the families of such persons residing with them and dependent upon them for support and other persons of the household of such persons residing with them and dependent upon them for support, and who are ineligible for aid from the state in which application is made to said corporation, without cost to such persons, of medical, surgical and dental treatment or services and any drugs, diets, nursing or hospitalization incident, necessary or convenient thereto, etc., which corporation is to have a capital stock of $5, and is to be a nonprofit corporation. It further appears from said articles of incorporation and by-laws that such services are to be rendered voluntarily by the corporation and are not to be based upon any agreement or contract between the corporation and the recipients of such benefits. You request my opinion whether or not the operations of such a corporation are subject to the provisions of chapter IX, Title XLVI, Oregon Code 1930, relating to hospital...
