Cavel, JUDGE            This matter came before the Court for a pretrial conference on September 7, 2007. The parties participated through counsel. The parties had previously provided to the Court a joint pretrial conference memorandum. On the basis of the memorandum and the conference, the Court finds the trial of this matter should be governed by the following:          I.          The Court will take judicial notice of its prior award of September 16, 1999.          II.          That the issues for trial of this matter should be limited to the following:
1. Whether the plaintiff has experienced a substantial and material decrease in incapacity due solely to the injury which is the subject of this litigation. 2. The entitlement of the plaintiff to vocational rehabilitation services. 3. The entitlement of the plaintiff to future medical care.
