STATEMENT
OF THE CASE
A
hearing was held on February 28, 2020, to determine whether
the above-referenced matter should be dismissed for failure
to prosecute.
The
record consists of the transcript of the February 28, 2020,
hearing and the documents contained therein. The entire
Commission’s file has also been made a part of the
record. It is incorporated into the hearing transcript by
reference.
Appropriate
Notice of this hearing was attempted on all parties to their
last known address, in the manner prescribed by law.
DISCUSSION
On May
6, 2015, the Claimant slipped and fell on the wet kitchen
floor injuring her left hip, left elbow, left wrist, and
hand, in the course and scope of her employment with the
respondent-employer. The Claimant’s former attorney
filed a Form AR-C, on behalf of the
Claimant.
Her attorney asserted the Claimant’s entitlement to
only additional workers’ compensation benefits
resulting from this accidental injury of May 6, 2015.
Specifically, in the Claim Information section of this Form
AR-C, her attorney asserted the Claimant’s entitlement
to said benefits, in the form of additional temporary total
benefits, additional temporary partial disability, additional
permanent partial, additional medical expenses,
rehabilitation, and an attorney’s fee.
