Senator Charles Pittman No. 19800114 Mississippi Attorney General Opinions January 14, 1980          Senator Charles Pittman          Legislative Services Offices          Post Office Box 1018          Jackson, Mississippi 39205          Re: Conflict of Interest Section 109, Mississippi Constitution of 1890 Section 97–11–19, Mississippi Code of 1972           Dear Senator Pittman:          Attorney General Summer has received your opinion request dated January 8, 1980, received by hand mail on January 11, 1980, and has assigned it to me for research and reply, your letter of request stating:

“I am scheduled to meet with the Wildlife Conservation Commission around January 16 to discuss the possibility of obtaining a right-of-way for public access into certain portions of the Maimaison Wildlife Refuge. “As you know, J. E.” Rusty' Hobgood is the chairman of the Wildlife Conservation Commission. Mr. Hobgood is also a member of the Oxberry Hunting Club. One of the right-of-ways being sought passes through this club. “I would appreciate your office preparing an opinion as to whether or not a conflict of interest would occur if Mr. Hobgood votes on the right-of-way issue at the commission meeting on this subject.'

         Section 109, Mississippi Constitution of 1890, states that:

“No public officer or member of the Legislature shall be interested, directly or indirectly, in any contract with the state, or any district, county, city, or town thereof, authorized by any law passed or order made by any board of which he may be or may have been a member, during the term for which he shall have been chosen, or within one year after the expiration of such term.'

         Section 97–11–19, Mississippi Code of 1972, states that:

If any public officer or member of the Legislature, or any officer, on any purchasing board of public contracts, shall be interested, directly or indirectly, in any contract with the state, or a district,
