PROVIDENCE SCHOOL DEPARTMENTOur File No.: PR 98-0542 Dear Ms. Coyle: The investigation in to your Access to Public Records Act ("Act") complaint against the Providence School Department ("School Department") is complete. By letter dated September 14, 1998, you requested from the Providence School Department twelve (12) categories of documents. The records you seek vary from witness statements given to the Providence Police Department to documentation regarding between a parent and a West Broadway School counselor to the Zero tolerance policy infraction logs at the West Broadway Elementary School for Grade 1 students for the 1994-1995 school year. The School Department, by letter dated September 28, 1998, informed you that your request was being reviewed. The School Department never provided you with a follow-up letter regarding the status of your request. It is important to note that you seek the records in conjunction with a suit pending in Providence County Superior Court entitled Janet Coyle v. City of Providence, by and through its Treasurer, Stephen Napolitano, CA No.: PC 95-3813 of which you are the Plaintiff. It appears that at least some of the records you seek in your Access to Public Records request have also been the subject of a discovery request under Superior Court Rules of Civil Procedure, Rule 34.
