DiRobbio Our File No.: PR 99-0046 Dear Mr. Tetreault: The investigation into your Access to Public Records Act complaint filed against the Superintendent of the Lincoln Schools, Dr. Robert A. DiRobbio, is complete. You allege that Dr. DiRobbio violated the Access to Public Records Act (APRA) by denying you access to "a private detective's report from D.B. Kelly Associates." You contend that this report was maintained within your personnel records at the School Department. In support of your complaint, you forwarded to this Department an article from the February 2, 1998 edition of The Providence Journal. We note that this article states that D.B. Kelly Associates was hired to perform surveillance on you, but that this article makes no reference to any report. In response to your complaint, we contacted legal counsel for Dr. DiRobbio, Benjamin M. Scungio, Esquire. Mr. Scungio represents that he contacted Dr. DiRobbio, as well as Dr. DiRobbio's secretary, and "[t]o the best of their knowledge and belief, there are no secret personnel files concerning Mr. Tetreault."
