Box 269          Bay St. Louis, Mississippi 39520          Re: Schools - 16th Section Leases Removing Sod and Top Soil           Dear Mr. Randolph:          Attorney General Bill Allain has forwarded to me for research and reply your request for an opinion on questions which you state as follows:
“1. Can 16th Section Lands be leased for the purpose of removing sod and top soil therefrom and offering it for sale? “2. If the answer to Question No. 1 is yes, does such a transaction fall within the provisions of Section 29-3-99? “3. If the answer to Question No. 1 is yes, on what terms may the sod be lawfully sold, and what royalties should be reserved to the Board of Education?”
