STATEMENT
OF THE CASE
A
hearing was held in the above styled matter on April 10,
2019, in Little Rock, Arkansas, on respondent’s Motion
to Dismiss for failure to prosecute pursuant to Arkansas Code
Ann. §11-9-702 and Rule 099.13 of the Arkansas
Workers’ Compensation Act. The claimant was pro se and
failed to appear for the hearing. The claimant alleged that
on or about May 11, 2017, she sustained injuries to her low
back and left hip arising out of her course of employment.
The respondents filed a Form AR-1 with the Commission on or
about May 23, 2017, and an AR-2 was filed on May 25, 2017,
denying the claim as compensable. On or about May 26, 2017,
the Legal Advisor Division of the Commission notified the
Claimant of the Respondent’s position, as well as
notifying the Claimant of the right to prosecute the claim.
On or about July 12, 2017, the Claimant filed a letter with
the Commission requesting a hearing. The parties agreed to
mediation and a Mediation Conference was held on October 3,
2017, during which an agreement was reached. On October 9,
2017, an Agreed Order confirming the Respondent’s
agreement to pay the Claimant’s initial medical
evaluation, as well as to reimburse the Claimant for her
out-of-pocket expense was executed, and the Respondents
complied. On or about March 1, 2018, the Claimant requested
another hearing before the Commission. On March 29, 2018, the
Claimant again filed a new Legal Advisor Questionnaire
requesting another Mediation Conference be held on her claim.
In April of 2018, this matter was transferred to the
adjudication division...
