Order
The
commission affirms the decision of the
administrative law judge. Accordingly, within 30 days from
this date Geminicares, Inc. and Insurance Company of State of
Pennsylvania (respondents) shall pay to the applicant
temporary disability compensation in the total amount of
Three Hundred Fifty-Nine dollars and Seven cents ($359.07);
to applicant's attorney, Dana W. Duncan, fees in the
amount of Eighty-Nine dollars and Seventy-Seven cents
($89.77); and to Dean Care reimbursement for medical expense
in the amount of Ninety-Five dollars and Ninety-Five cents
($95.95). This is a final order.

Procedural
Posture
The
applicant filed a hearing application on August 1, 2016,
claiming compensation attributable to a work-related injury
sustained during employment with the employer on June 3,
2011. Respondents filed an answer disputing the claim and an
administrative law judge (ALJ) for the Department of
Administration, Division of Hearings and Appeals, Office of
Worker's Compensation Hearings held a hearing in the
matter on March 26, 2018. On June 5, 2018, the ALJ issued a
decision that awarded the compensation set forth above, but
otherwise dismissed the applicant's claim. The applicant
filed a timely petition for commission review.
The
commission has reviewed the evidence submitted at the hearing
and considered the petition, together with positions of the
parties. Based on its review, the commission agrees with the
decision of the ALJ. The commission adopts that
decision's findings and conclusions as its own.
