STATEMENT
OF THE CASE
A
hearing was conducted in the above-styled claim on the Motion
to Dismiss filed herein by respondents. The claimant reported
that he suffered an injury within the course and scope of his
employment on January 5, 2016. The claim was ultimately
denied by the respondents. In correspondence of June 9, 2016,
the claimant requested a hearing before the Arkansas
Workers’ Compensation on the claim. Pursuant to the
claimant’s hearing request, the claim was assigned to
the Adjudication Division of the Commission, and prehearing
questionnaire documents were forwarded to the parties. Prior
to the scheduled prehearing conference the claimant submitted
correspondence reflecting that he was no longer in pursing
the workers’ compensation claim. In accordance with the
afore, the scheduled prehearing teleconference was canceled
and the file returned to the general files of the Commission.
On
December 13, 2017, respondents filed a Motion to Dismiss the
claim for want of prosecution. On December 14, 2017, notice
of the Motion to Dismiss was forwarded to the claimant by
certified mail - return receipt requested. On December 20,
2017, the claimant submitted a waiver of his right to a
hearing before the Commission on the Motion to Dismiss.
DISCUSSION

D. Richardson, the claimant, with a date of birth of May 20,
1950, commenced his employment with respondents on April 23,
