         Mr. Joe Sharp          Motor Vehicle Comptroller          Woolfolk State Office Building          Jackson, Mississippi           Dear Mr. Sharp:
Attorney General Bill Allain has received your letter of request under date of October 25, 1979, and has assigned it to this writer for research and reply.
         Your letter states as follows:
“Section 75-57-49, Mississippi Code of 1972, requires certain insurance coverage to engage in the LP Gas business. The below listed is the insurance requirements: TABULAR OR GRAPHIC MATERIAL SET FORTH AT THIS POINT IS NOT DISPLAYABLE “My first question; 'Is employers liability insurance coverage required where a man and wife own and operate a LP Gas firm as Atlas Gas Co. and have no employees other than themselves.' “My second question; 'Is employers liability insurance converage required where a man and wife own and operate a LP Gas firm and the firm is incorporated as Atlas Gas, Inc., and they have no employees other than themselves.”'
         Section 75-57-49, Mississippi Code of 1972, Annotated, provides in part as follows:
“Provided further, that before any person, firm or corporation shall be granted a permit to, or shall engage in or continue in the business of the distributing, either wholesale or retail, installing, altering, extending, changing or repairing of any liquefied compressed gas system, or container, or in the business of distributing and selling liquefied compressed gas, either at wholesale or retail, whether from trucks or other vehicles, in cylinders or in any other manner, such person, firm or corporation shall satisfy the motor vehicle comptroller that he or it is financially responsible; and this provision as to financial responsibility shall be met by such person, firm or corporation by filing with the motor vehicle comptroller evidence that he or it has in force such of the hereinafter listed insurance policies on standard contract forms and written by an insurance company, or companies, qualified to do business in the State of Mississippi, as the comptroller shall require, based upon those of the activities listed above in which such person is engaged, to wit: TABULAR OR GRAPHIC MATERIAL SET FORTH AT THIS POINT IS NOT DISPLAYABLE Provided, however, that the comptroller shall
