STATEMENT
OF THE CASE
A
hearing was conducted in the above-styled claim on the Motion
to Dismiss filed herein by respondents. The claimant was
provided appropriate notice of the Motion to Dismiss, via
Certified Mail – Return Receipt Requested, at her
current address. The claimant failed to respond to the notice
letter, and as a consequence of that failure, a hearing was
scheduled on the Motion before the Arkansas Workers’
Compensation Commission. The claimant failed to attend the
scheduled hearing.
Comprising
the record in this claim is the Motion to Dismiss filed by
respondents, as well as an exhibit consisting of sixteen (16)
pages, along with the entire file of the Arkansas
Workers’ Compensation Commission in this claim.
DISCUSSION
Jennifer
Smith, the claimant, with a date of birth of July 24, 1978,
commenced her employment with respondent on September 2,
2002, as an auditor. The claimant asserts that she suffered
an injury arising out of and in the course of her employment
September 9, 2015. The claimant asserts that after sitting at
her desk working her eight (8) hour shift to make a deadline,
she felt a sharp pain in her lower back when she adjusted her
seat to take a break and got up. The record reflects that the
claimant last worked on September 9, 2015, and that she
notified respondent of her injury on September 10, 2015.
