         Opinion, Community Hospital          Honorable Hubert D. Stephens          Attorney-at-Law          Post Office Box 300          Iuka, Mississippi 38852          Dear Mr. Stephens:          Attorney General Summer has received your letter of request dated December 7, 1979, on behalf of the Tishomingo County Hospital and has assigned it to the undersigned for research and reply.          You are asking if the hospital may legally establish an out-patient clinic within its physical plant for the purpose of attracting an ophthalmologist in light of Section 41-13-15, Mississippi Code of 1972, which authorized the board of trustees of that hospital to construct and maintain a doctors' building on hospital property. You are further asking if the establishment of the proposed out-patient clinic would be in violation of the precedent established in the case of Prichard v. Cleveland, 314 So.2d 729.          Section 41-13-43, Mississippi Code of 1972, as amended, gives the Boards of Trustees of community hospitals certain additional powers and authorities, and prescribes in part:
(a) To offer the following in-patient and out-patient services, whether or not heretofore offered by such hospital or other similar hospitals in this state and whether or not heretofore authorized to be offered, long-term care, extended care, home care, rehabilitation and diagnostic and treatment services; to promote, develop, operate and maintain a center providing care or residential facilities for the
