Wilford          Chairman          Mississippi Health Care Commission          2688 Insurance Center Drive          Jackson, Mississippi 39216          Executive Order No. 295 of Governor Cliff Finch           Dear Mr. Wilford:          Attorney General Allain has received your request for opinion and has referred it to the undersigned for research and reply.          You refer to Section 41-7-171, et seq., Mississippi Code of 1972, Annotated & Amended, known as the “Mississippi Health Care Commission Law of 1979, ” wherein the Mississippi Health Care Commission was established and the number of the members and their method of appointment is expressly set forth in Section 41-7-177, Supra.          You also refer to Executive Order No. 295 issued by Governor Finch on January 12, 1980, and attach a copy. The Executive Order purports to create two additional members of the Mississippi Health Care Commission as so-called “Ex Officio Members” which purport to be in addition to the number of members, being seven in all, specified in Section 41-7-177, Supra.          You then present for opinion the question of whether such additional members attempted to be provided by the Executive Order are valid.          It is so well...
