Interlocutory
Order
The
commission affirms the decision of the
administrative law judge (ALJ) subject to the
modifications set forth below.
Accordingly,
within 30 days from this date, Century Foods International,
LLC and Zurich American Insurance Company (respondents) shall
pay to the applicant compensation in the amount of Nineteen
Thousand Five Hundred Three dollars and Forty-Eight cents
($19,503.48); to the applicant as reimbursement for medical
expense the sum of Six Thousand Nine Hundred dollars
($6,900.00); to applicant's attorney, Jaron Mosier, fees
in the amount of Five Thousand Forty-Three dollars
($5,043.00), plus costs in the amount of Six Hundred
Sixty-Eight dollars and Fifty cents ($668.50); and to the
insurance carrier identified in applicant's WKC-3-E as
"Loss and damage ins.," reimbursement for hearing
aid expense in the amount of Two Thousand One Hundred dollars
($2,100.00).
Jurisdiction
is reserved for such further findings and orders as may be
necessary. This includes the possibility of future claims for
hearing aids prescribed by a physician and reasonably
required as a result of the occupational hearing loss injury
of June 3, 2016. The commission's order is final with
respect to all other issues of compensation claimed to be
attributable to the occupational hearing loss injury of June
3, 2016.
Procedural
Posture
On
March 6, 2017, the applicant submitted a hearing application
claiming an occupational hearing loss arising out of, and
sustained in the course of, his employment with the employer.
The occupational date of injury claimed is June 6, 3, 2016.
