         This matter was submitted on the record before ADMINISTRATIVE LAW JUDGE CHANDRA L. BLACK, on February 12, 2018, Pulaski County, Little Rock, Arkansas.           The claimant was represented by Mr. Jason M. Hatfield, Attorney at Law, Fayetteville, Arkansas.           Respondents were represented by Mr. David L. Jones, Attorney at Law, Little Rock, Arkansas.           CHANDRA L. BLACK, ADMINISTRATIVE LAW JUDGE          STATEMENT OF THE CASE          This matter comes before me for the purpose of dealing with the respondents’ Motion to Dismiss and to determine whether the above-referenced matter should be dismissed under Commission’s Rule 099.13.          The record consists of the Commission’s entire file, which is incorporated herein by reference.          DISCUSSION          The claimant was involved in a motor vehicle accident on August 1, 2016. The claimant filed a Form AR-C with this Commission December 5, 2017. He basically alleged injuries to his left shoulder, left wrist, upper back, right knee, right ankle and head due to a motor vehicle accident.          Previously, the respondents accepted this claim as compensable and paid the claimant some temporary total disability compensation, temporary partial disability compensation, and some medical benefits. Medical records demonstrate that the claimant has been treated and evaluated by Miriam Lawrence and Shannon Ayers, at Concentra, in North Little Rock, Arkansas.          Since this time, a controversy has arisen between the claimant and respondents over potential subrogation interest in regard to the pending third party settlement arising from the motor vehicle accident in Indiana, with the claimant residing in Illinois.
